”Won’t accept fault” vs “won’t sign”
Here it helps to separate two different situations:
- Won’t accept fault but still takes part: Even if statements conflict, if both parties sign the adjuster report can be drawn up. Unlike the simple mutual report drivers fill in themselves, the SBM-registered insurance adjuster sets out the fault opinion through an independent assessment under Law 5684 art. 22/17. This is exactly where the adjuster report proves useful.
- Refuses the process entirely / won’t sign: The adjuster report can’t be drawn up. In that case, call the police — 155 in cities, 156 (gendarmerie) in rural areas. The authorities make an official determination at the scene.
Document the scene anyway
Whatever the other party does, documenting the scene works in your favor. Photograph and film the vehicles from different angles without moving them; make sure the plates, the damage and the road conditions are clearly visible. If possible, record the other vehicle’s plate and any insurance policy details.
