Stay calm if the other driver won’t agree
One of the most stressful scenarios after an accident is the other driver refusing to accept fault or refusing to sign the report. The argument can escalate and both parties may be tense. First, know this: for the adjuster report to be drawn up, both parties must take part and sign. This is the core rule that keeps the process fair and binding.
The good news: “not accepting fault” and “refusing the process entirely” are two very different things, and in most cases your situation is easier than it looks. Even if the other party won’t admit fault, as long as they sign and take part, an independent insurance adjuster can provide a technical assessment based on the scene findings. And if the other party won’t cooperate at all, don’t panic — follow the steps below in order.
The critical difference: “won’t accept fault” vs “won’t sign”
Separating these two situations clearly determines which step you take next:
Won’t accept fault but still takes part
This is the most common case — and actually the easiest to resolve. Even if the other party says “I’m not at fault,” as long as they take part and sign, the adjuster report can be drawn up. Unlike the simple mutual report drivers fill in themselves, the authorised registered insurance adjuster sets out the technical opinion through an independent assessment under Law 5684 art. 22/17. The file is therefore not limited to the drivers’ statements. Even when statements conflict, the adjuster report can give the claim stronger evidential support.
Refuses the process entirely / won’t sign at all
If the other party wants to leave the scene, won’t sign under any circumstances, or rejects the process altogether, the adjuster report process depends on the concrete situation and required approvals. In that case, call 112 if authorities are needed. Meanwhile, keep documenting the scene on your own device.
Won't accept fault + signs
The adjuster report can be drawn up. The independent adjuster sets out the technical opinion; a conflict in statements is not a problem.
Won't sign / refuses
The adjuster process depends on the concrete situation. Call 112 if authorities are needed.
Left the scene / fled
Document the damage, surroundings, cameras and witnesses; record the plate and call 112.
Document the scene anyway
Whatever the other party does, documenting the scene always works in your favor. Photograph and film the vehicles from different angles without moving them; make sure the plates, the damage and the road conditions are clearly visible. If possible, record the other vehicle’s plate, the driver’s name and any traffic insurance policy details. Note any nearby security cameras or witnesses.
These records become your firm basis in any later claim or dispute process, whether you move to the adjuster process or the authorities prepare their own record. Quietly documenting instead of getting into an argument is the right path for both your safety and your file.
How does it work?
- 1
Stay safe, don't argue
Switch on hazards, move to a safe spot if needed; don't escalate the tension.
- 2
Document the scene
Without moving the vehicles, record photos, video, plates and any policy details.
- 3
Call the 24/7 line
The call is answered in about 45 seconds; the expert assesses your situation and guides you.
- 4
Adjuster process or authorities
If the other party takes part, the adjuster process can continue; if they refuse and authorities are needed, call 112.
Common mistakes
In these tense moments, the most common mistakes can jeopardise both your safety and your claim file. Avoid these:
- Escalating the argument: Verbal disputes over fault change nothing; technical assessment is prepared not by statements but by the independent adjuster’s opinion or the official determination.
- Leaving without details: It becomes hard to open a file without the plate, the driver’s name and policy information. Always document before leaving the scene.
- Relying only on a verbal agreement: Verbal promises like “I’ll sort it out” are not binding. Don’t proceed without an adjuster report or an official determination.
- Forcing the other party to sign: A signature must be voluntary. If they won’t sign and authorities are needed, call 112 instead of forcing it.
Why does the other party sometimes refuse?
The other driver refusing to accept fault isn’t always bad faith; often they genuinely see how the accident happened differently, or worry about the effect on their premium. That’s why turning to an independent assessment, rather than arguing, is the healthiest path. This is exactly where the adjuster report’s strength comes in: who is right is established not by the parties’ statements but by the opinion of an independent expert working from the scene data. Unlike the simple mutual report drivers fill in themselves, this protects your file even when the other party won’t accept fault.
